Learner rules

Preamble

These internal rules apply to all learners enrolled on a training or certification activity organised by Linguaid France, a société par actions simplifiée with share capital of €10,000, registered with the RCS of Perpignan, whose registered office is at 2 rue Hergé, 66750 Saint-Cyprien, France. Linguaid France is registered as a training provider with the regional prefect under number 91660162066. Linguaid France is also a certifying body authorised to issue the certification registered in the Répertoire Spécifique “Communiquer en anglais juridique des affaires (CAJA)” (RS6810).

In accordance with articles L.6352-3 to L.6352-5 and R.6352-1 to R.6352-15 of the French Labour Code, these rules establish the general rules applying to learners; specify health and safety rules; define disciplinary rules; govern the conduct of training and assessments/certifications; and inform learners of their rights and obligations, in particular for remote training. The rules are given to every learner before entry into training or certification and are available at any time on https://certification-caja.fr.

Article 1 – Scope

These rules apply to everyone taking part in a training activity organised by Linguaid France and to everyone sitting the assessments of the CAJA certification, wherever they take place — face to face, virtual classroom, video conference, LMS platform (ManageAll), client premises or remotely — and whether the training is funded individually, by the employer, by an OPCO, by France Travail or under the CPF.

Article 2 – General rules

2.1 Attendance and punctuality. Learners undertake to attend scheduled sessions, respect the timetable, inform the trainer or administration of any absence or lateness, and sign attendance sheets electronically or on paper where required by the OPCO or France Travail. Any unjustified absence may result in interruption of the training, loss of funding, or inability to sit the certification.

2.2 Conduct. The following are strictly prohibited: discriminatory remarks or behaviour; moral or sexual harassment; threats, verbal violence or inappropriate attitudes; deliberate disruption of a training or assessment session.

2.3 Recordings. Recording sessions (Zoom, Teams, face to face) is strictly prohibited for learners without Linguaid’s written authorisation.

Article 3 – Remote training charter

For remote training, learners undertake to connect under their real name, switch on their camera when asked so attendance can be verified, have a stable connection, refrain from interrupting sessions for personal reasons, and respect the confidentiality of content and exchanges. Linguaid uses Zoom, ManageAll (LMS), Google Workspace and Microsoft 365 to deliver training.

Article 4 – Health and safety

Where training takes place on third-party premises (client company, hired centre), learners must comply with the site’s safety instructions, traffic rules, fire instructions and procedures for welcoming people with disabilities, and must immediately report any incident or dangerous situation.

Article 5 – Discipline: sanctions

In accordance with articles R.6352-4 to R.6352-8, the disciplinary sanctions that may be applied are: written warning; reprimand; temporary exclusion from the training; permanent exclusion from the training; exclusion from a certification session (plagiarism, cheating, fraud, disruptive behaviour). No sanction may be imposed without the learner being informed in writing of the allegations and given the opportunity to respond.

Article 6 – Disciplinary procedure

Written notification of the alleged facts; opportunity for the learner to explain at an interview; reasoned decision by Linguaid; written notification of any sanction.

Article 7 – Prevention of discrimination and harassment

Pursuant to articles L.1152-1, L.1153-1 and L.1132-1 of the French Labour Code, the following are strictly prohibited: any discrimination on a ground prohibited by law; any act of sexual or moral harassment; any attack on a learner’s dignity; any creation of an intimidating or offensive environment. Any learner who witnesses or suffers such conduct may immediately contact contact@linguaid.fr.

Article 8 – Personal data (GDPR)

Linguaid France applies the General Data Protection Regulation. Data collected: identity, contact details, professional information; learning and assessment data; connection data (Zoom, LMS); questionnaire answers; CAJA certification results. Purposes: administration, skills assessment, learning follow-up, enrolment for certification, issue of attestations and certificates. Processors: Google, Microsoft, Zoom, ManageAll, MailChimp, Pipedrive. No data is sold or passed to unauthorised third parties. Rights: access, rectification, objection, erasure, portability via contact@linguaid.fr.

Article 9 – Rules specific to the CAJA certification

Candidates undertake to follow assessors’ instructions strictly, submit to the identification protocol (identity card), complete the tasks alone, not use prohibited aids, and behave with dignity and respect. Any cheating results in cancellation of the assessment and a 12-month bar on resitting the certification. Results are communicated within 30 days at most.

Article 10 – Access for people with disabilities

Linguaid applies the principle of equal access to training and certification and offers adjusted assessment durations, adapted materials, assistive technology and liaison with partner disability officers. Disability contact: handicap@linguaid.fr.

Article 11 – Learner responsibility

Learners are responsible for the proper use of the digital tools provided, the confidentiality of documents, the upkeep of their own equipment for remote sessions, and the safekeeping of their login credentials.

Article 12 – Publication

These rules are given to the learner before entry into training, made available on the website, may be sent to the funder (OPCO, France Travail, company), and apply to all sessions from their publication.
