« We'd like to close the Paris store by Christmas. »

JulienGood morning, Katrin. Thank you for sending the lease over yesterday. I've been through it.

KatrinThank you for reading it so quickly. The situation is simple: the store isn't working, and head office wants out. We'd like to close the Paris store by Christmas and hand back the keys.

JulienI see. Before we talk about Christmas, may I ask when the lease started?

KatrinIn June 2024. So about two and a half years ago.

JulienRight. This is a standard French commercial lease, what we call a "three-six-nine". It runs for nine years, and as the tenant you can only terminate at the end of each three-year period. The first exit date is therefore June of next year, and you'd have to give six months' notice.

KatrinSo we're locked in until next June, whatever we do?

JulienUnder the lease itself, yes. If you simply hand back the keys, the rent keeps running and the landlord can sue for every month until June.

KatrinThat's not what head office wants to hear.

JulienI understand. But there are three ways out, and two of them are quicker. First, the notice route: we serve notice now for next June, and you keep the store open or closed until then, as you prefer. Second, an early surrender agreed with the landlord. He may accept the keys early in exchange for a lump sum, especially if he already has another tenant in mind. Third, assigning the lease to a new tenant, with the landlord's consent.

KatrinWhich one would you go for?

JulienI'd pursue the second and third at the same time. We approach the landlord this week with a surrender offer, and in the meantime we find out whether a neighbouring retailer wants the premises. A good location like yours rarely stays empty.

KatrinAnd if the landlord refuses everything?

JulienThen we fall back on the notice route, and you'll have budgeted for it. Shall I draft the letter to the landlord so you can share it with head office?

KatrinYes, please. In English, if possible.

JulienOf course. You'll have both versions by Thursday.

  3. There are three ways out, and two of them are quicker.Transformer une mauvaise nouvelle en plan. Vous annoncez le nombre d'options et vous hiérarchisez d'emblée.
  4. I'd pursue the second and third at the same time.Recommander sans imposer : « I'd » (I would) est la formule du conseil, pas de l'ordre.
  5. Then we fall back on the notice route.Nommer le plan B à l'avance. Le client voit que vous avez prévu le refus.
